The Arns Commission has supported the Institute for Defense of the Right to Defense (IDDD) in a request to the Federal Supreme Court (STF) so that provisional, sexagenarian, and chronically ill prisoners who have not committed serious crimes can serve their sentences in home detention or wait for their trial out of custody in order to contain the spread of COVID-19 in prisons.

In an official letter sent on April 30th to the National Council of Justice and to the São Paulo Court of Justice, the Commission reinforced the recommendation of Justice Marco Aurélio, who accepted the request for judges of criminal executions to take urgent measures to avoid an outbreak of contamination. The suggestions can be adopted by local courts to avoid the contamination of the prison population.
